Protection Of Quality Mark a.The responsibility of the Association to assume an attitude against any misuse of the quality mark binds the members of Association as well. The members of Association, for the follow-up of such injury properly, have to make such misuses that they witnessed known to the "Quality Union" Association with reliable evidences. Any neglects are punished as per article 5.1. b. In the cases that any member uses the quality mark without authorization or transfers the right of using the mark to a third person to use on its plastic window profiles, or allows such person to use the mark, such member may be ordered to pay a contractual fine in Turkish currency equivalent to DEM 10.000.- per case (articles 5.1 and 5.7). Any legal processes which may arise therefrom, may be kept independent from that matter. c.In the event that some measures to be taken by the union for the purpose of protecting the quality mark, make the users of the mark injured, such users of the mark are authorized to exercise their legal rights for seeking remedy for their certain losses. |
